Description of The Law of Trees, Forests and Hedgerows

There is a great deal of law surrounding the question of trees and forestry. Trees, forestry and woods are boundaries; boundaries are neighbours, and neighbours equal litigation. Entwined in that litigation are questions posed by planning, environmental and property law alike.

This book provides a specialized text dealing with the property, planning and environmental implications arising from all aspects of forestry and trees. The work is divided into five main sections, dealing with the general law, forestry, protection of trees under planning legislation, other forms of protection, and precedents.

Contents of The Law of Trees, Forests and Hedgerows

The book begins with an introductory chapter providing a historical background and general overview.

Part II then sets out comprehensively the general law relating to trees. It deals with such questions as:

- who owns and is responsible for trees
- the difficulties that arise where trees and hedges are on boundaries
- liability for hazardous trees
- issues relating to highway trees
- trees and statutory undertakers
- carrying out works to existing trees
- planting new ones

The law relating to commercial forestry is outlined in Part III, touching on financial considerations, the new requirement for environmental impact assessment, and the need for felling licences.

Part IV looks at the legal mechanisms aimed at protecting trees and woodlands of particular value - notably tree preservation orders, and the protection of trees on development sites, in conservation areas and in churchyards.

The last part examines the new procedures for protecting important hedgerows.
